1. What Bit is

Bit is an iPhone app for making short audio clips and sending them to people you choose inside iMessage. It is operated by One Percent Studios LLC ("we").

Before creating or sending a sound, Bit asks you to affirmatively agree to the current version of these Terms and the Privacy Policy. You may decline and keep using the parts of Bit that let you manage sounds already in your library.

2. You must be 13 or older

Bit is not for children under 13, and we don't knowingly let them use it. If you're under the age of majority where you live, you may use Bit only with a parent or guardian's permission.

3. Your content is yours, and it is your responsibility

You keep your ownership rights in the sounds you make. You give us only the limited, non-exclusive license needed to operate Bit at your direction: to encode, transform, display, attach, transmit, and otherwise process a sound through the Bit app, its Messages extension, your private iCloud storage, and Apple's Messages infrastructure. This license does not let us use your sound for advertising, promotion, a public catalog, or any purpose unrelated to providing Bit. It ends when it is no longer needed to provide those actions, except that copies you already sent remain with their recipients.

We do not receive or host ordinary user audio on Bit servers. Sounds stay on your device and in your own iCloud account, and they travel to your friends through Apple's Messages infrastructure.

That architecture has a direct consequence: we cannot review what you make before you send it, and we cannot take it back afterwards. So the responsibility is yours. Each time you save a newly recorded or imported sound, Bit asks you to confirm that:

• you created it, or you have the rights and permissions needed to use it;
• everyone whose voice is audible has agreed to be recorded and to have that recording shared;
• it doesn't infringe anyone's copyright, trademark, publicity, or privacy rights; and
• it isn't unlawful, harassing, threatening, hateful, or sexual content involving anyone who has not consented, and never content involving a minor.

3.1 Recording other people

Recording someone without their consent is illegal in many places. The consent required for a private conversation depends on the law that applies where the recording occurs and where the participants are.

Bit gives you a recorder. It does not give you permission. Getting consent is your responsibility, before you hit record, and the law that applies is the law where you and the people you're recording are.

3.2 Audio taken from video

Bit can pull the audio out of a video in your photo library. Use that on videos you made, or on audio you're otherwise allowed to use.

A short clip is not automatically fair use. Length has little to do with it, and taking a few seconds of a song, a film, or someone else's video and sending it around can still infringe.

4. What you can't do

Don't use Bit to:

• record anyone without the consent the law requires;
• copy, distribute, or make derivative works from audio you don't have rights to;
• harass, threaten, impersonate, defame, or intimidate anyone;
• share sexual content involving anyone who has not consented, or any sexual content involving a minor;
• break any law, or help anyone else break one;
• reverse engineer, decompile, or tamper with the app, or interfere with our servers or the reporting system;
• submit safety reports you know to be false.

5. Reporting, and what we can actually do about it

Bit has a Report this sound control in both the app and the Messages extension. It sends us information about a sound: an identifier, a one-way fingerprint, its name and length, the category you chose, your description, and your email if you provide one. It never sends us the audio, because we never have the audio.

If we act on a report, Bit will refuse to save or send that specific sound going forward, on devices running Bit.

Be clear about the limits. We cannot:

• delete a sound from anyone's phone;
• remove anything from a Messages conversation;
• recover or view a sound in order to review it ourselves; or
• recognize a copy that has been re-trimmed, re-recorded, or re-encoded, because the fingerprint no longer matches.

We aim to review reports promptly, but we don't promise a response time, and acting on a report is at our discretion. Restrictions are reversible and can be lifted on review.

Formal copyright notices should go to copyright@onepercentstudios.net rather than through the in-app report, which is a preliminary review channel and not a statutory notice process.

6. Bit+

Bit+ is an auto-renewing subscription sold through the App Store.

• Payment is charged to your Apple ID at confirmation of purchase.
• It renews automatically for the period and price shown by the App Store until you cancel.
• Any introductory offer is shown only when Apple reports that your account is eligible.
• You can manage or cancel the subscription in your App Store account settings.

Refunds are handled by Apple under its own policies, not by us.

7. Your license to use Bit

We give you a personal, non-exclusive, non-transferable, revocable license to use Bit on Apple devices you own or control, for your own non-commercial use. We keep all rights in the app itself: the software, the name, the design.

8. We can suspend access

We may limit or stop your access to Bit's server-backed features if you break these terms, meaningfully or repeatedly. Because Bit works almost entirely offline, this mostly affects the reporting system and any purchased content.

9. No warranty

Bit is provided "as is," without warranties of any kind, to the fullest extent the law allows. We don't promise it will be uninterrupted, error-free, or that it will preserve your sounds.

Back up anything you can't afford to lose. iCloud backup depends on your own iCloud account and on Apple's service, neither of which we control.

10. Limitation of liability

To the fullest extent permitted by law, One Percent Studios LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising out of your use of Bit. Our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or $50.

Some jurisdictions don't allow these limits, in which case they apply only as far as the law permits.

11. Indemnity

You agree to indemnify One Percent Studios LLC against claims arising from content you recorded, imported, saved, or sent, including claims that it infringed someone's rights or was recorded without required consent.

12. Apple

Apple is not a party to these terms and has no obligation to provide support for Bit. Apple is a third-party beneficiary of these terms and may enforce them against you. If Bit fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any.

13. Changes

We may update these terms. If a change is material, we will update the effective date and version above. Bit will require you to affirmatively agree to the new version before you can create or send another sound. Declining a new version does not by itself delete sounds already in your library.

14. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of them or out of your use of Bit will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.

Nothing here takes away a right you have under the consumer-protection law of the place you live that cannot be waived by agreement.
